Hiring A Foreign Nanny to Provide Child Care

Can a Nanny from aborad apply for an employment-based immigrant visa?

 

Yes, an employer can now apply to sponsor an alien as a Nanny or Nanny/Household Manager, under the EB3 employment-based immigrant visa.

 

The new PERM regime now classifies the occupation of “Nanny” as a “Skilled Worker” instead of the previous classification of “Other Worker.” The newly defined classification, gives way for favorable treatment by the USCIS as the SVP (Specific Vocational Preparation) range for the occupation of Nanny is now 6.0<7.0. This means this occupation now requires training in vocation schools, relevant work experience, and/or an associates’ degree under PERM. A bachelor’s degree may even be required for some positions. A Nanny’s duties may include, but are not limited to, the following:

  • Ability to perform CPR and first aid.
  • Preparation and planning of meals
  • Transportation of children
  • Regulation of child’s rest periods.
  • Participation in regular meetings with parents to discuss child activities and development.
  • Child instruction on safe behaviors such as crossing the street with an adult and avoiding dangerous objects.
  • Organization and implementation of age-appropriate activities for children.
  • Observation of child’s behavior for irregularities such taking child’s temperature, transporting child to the doctor, maintaining child’s health.
  • Cultivation of interpersonal relationships and communication skills and the performance as a role model of appropriate social behaviors.
  • Participation in the implementation of discipline programs to promote desirable behaviors in the child.
  • Observation and development of family schedule.

High demand in the EB-3 category has caused potentially long waits for green cards due to a backlog of applications.

How Can A Nanny Obtain An EB-3 Visa?

 

 

If you want to enter the U.S. as an EB-3 worker, you must go through the following multi-step process:

  • Your prospective employer must determine if you are eligible for lawful permanent residency in the U.S.
  • Your prospective U.S. employer must complete Application for Permanent Employment Certification, Form ETA-9089, and submit it on your behalf to the Department of Labor’s Employment and Training Administration. Labor must either grant or deny the certification request
  • The USCIS must approve Form I-140, Petition for Alien Worker, filed on your behalf
  • The State Department must give you an immigrant visa number
  • If you are already in the U.S., you must apply to adjust to permanent resident status after a visa number becomes available
  • If you are outside the U.S., you must complete your immigrant visa processing at the U.S. Consulate

End Crying When Going To Daycare

A crying child inevitably has the effect of making a parent feel guilty for leaving him or her with a babysitter or when dropping the child off at day care. To solve this problem one might consider two important truths.

First, the tears may make a parent feel guilty, or regretful, but unjustifiably so. Most likely, whatever it is the parent is about to do is something at least indirectly necessary for the well-being of the child, whether it is going to work or shopping or to a class or a meeting.

Guilt will lead to showing regret & showing regret ultimately reinforces the child’s tears. A parent who gingerly continues on his or her mission will quickly extinguish such behavior rather than reward it. But who among us has easily been able to do this? Truth number one: you shouldn’t feel guilty for leaving a child behind if the reason is legitimate and the child is left in good hands.

Second, the child’s tears have a purpose and that purpose is not to express pain. It is to change your behavior. At the risk of minimizing the child’s feelings or sounding cynical, the child is – at some level – seeking to manipulate the about-to-leave parent into not leaving.

I say this only because manipulation is a strategy you can win. You are smarter and more clever than your child — at least for now.

Here’s what to do to extinguish that transitional crying that comes with separation. As your car begins to approach the day care center (or as you are getting ready to leave the house) look earnestly into your child’s eyes and say, ‘I know it upsets you when I leave (you at day care) and that’s ok. I used to cry, too, when my Mom left me to go to work (or school, or to go ‘out’). Crying is a way to tell me you’re unhappy about it. I understand. So if you want to cry, this is a good time to start. We are almost there. (Or, ‘I’m almost ready to leave.’)’ Urge your child to cry. Practice a few times until you can say it with conviction and confidence.

Instead of trying to get your child not to cry, encourage him or her to cry. Do this and you will be letting the child know that crying is not going to change your mind or your schedule. There will no longer be any reason to cry and at some pre-conscious level he or she will realize that. The child may feel out-manipulated, and get angry with you, but he or she will not cry. Theorists of change call this ’symptom prescription’ and it works to solve many problems.

From Hooker To Child Care: Craig’s List Puts Your Children At Risk

After being arrested and charged as the head of a prostitution ring, the “HEIDI FLEISS of HOUSTON” – free on bail, is now Using Craig’s List to solicit nannies and parents for her new career: Child Care Nanny Agency Recruiter. woman and her husband were recently arrested for running the largest prostitution ring ever known in Houston.

The police searched their home and found $40,000 in cash, several gold and silver bars and confiscated their two vehicles. They have two little girls ages 1 and 3. The day following the arrest a nanny applied at a local nanny agency and said her employer was having financial problems and that she was let go just the day before – she provided a reference name – and it was the same name that was being reported in the news in connection with the prostitution ring.

IT’S A SMALL WORLD

You see, about a week earlier the agency had run an ad on Craig’s List to hire administrative help for the office. A woman responded with a very impressive resume – Masters Degree in Psychology, educated in England, 10 years of recruiting, etc. The agency didn’t immediately put two and two together and scheduled an interview to meet her at their offices.

The next morning her name rang a bell and they checked the internet and found several news stories that confirmed: this was the person that the Houston media was referring to as the Houston “Heidi Fleiss”. They immediately cancelled the interview.

Yesterday, one of the agency’s employees was checking Craig’s List for people that were advertising themselves as nannies and found an ad for a “Nanny Recruiter” who they’d never heard of before. They tend to know the legitimate competition in the area, like all established, reputable agencies. They couldn’t figure out who it could be – and they’ve been in business in Houston for decades. They were very curious because many of the words in the AD were obviously taken from this agencies website. They did a reverse phone look-up and found that it was this same woman who had tried to apply at their office.

The “Houston Madam” is now using Craig’s List for recruiting child care providers. That same day the major TV channels and one newspaper ran the story. The Turbivilles, who use Craig’s List as their marketing tool for prostitutes and nannies, do so because it’s free or cheap and without regulation or monitoring. They just want to do it on the cheap, with no interference from outside influences like trade organizations, law enforcement or government – They don’t really care what service they broker. Their attitude appears to that because they are ‘hard-working, family oriented people’ that they are above the law. It’s a pervasive attitude among many in our society that says as long as you don’t get caught, there’s nothing wrong with purposely doing what is illegal.

Avoid Using Systems That Put Your Familiy At Risk!

Smart parents and care providers have always known that using free bulletin board web sites like craigslist.com is dangerous and extremely risky. As if the murder of Katherine Ann Olson (who responded to a Craig’s List Ad for a Nanny) wasn’t enough of a wake up call, we can now confirm that parents are putting their children at serious risk when they turn to unregistered, unaffiliated “nanny agencies”.

Rules To Live By:

  • Never use a website that does not provide some type of ID Verification of the Parents or Agency
  • Never use a website site that does not allow you to keep all of your personal information (including your email address) private
  • Always check and verify references before agreeing to meet anyone in person who you found “on the internet”
  • Always conduct a background check and investigation before hiring someone to watch your children
  • Verify the legitimacy of a nanny agency by visiting the International Nanny Association (INA) website.
